SECTION 5.20 PAY ADMINISTRATION

PAY UPON PROMOTION [DAS-HRE Rule 11 IAC— 53.6(6)]
a. Non-contract classes. If an employee is promoted to a non-contract
class, the employee may be paid at any rate in the pay grade of the pay plan to
which the employee's new class is assigned.
b. Contract classes. If an employee is promoted to a contract
class without steps, the employee shall receive a 5 percent pay increase.
c. Employees
in contract classes in pay plans with steps shall receive a one step increase.
PAY UPON DEMOTION [DAS-HRE Rule 11 IAC— 53.6(7)]
Demotion. If an employee demotes voluntarily or is
disciplinarily demoted, the employee may be paid at any step or pay rate in the
lower pay grade that does not exceed the employee's pay at the time of
demotion.
PAY UPON TRANSFER [DAS-HRE Rule IAC— 53.6(8)]
If an employee
transfers under DAS-HRE rules to a different class, the employee shall be paid
at the employee's current pay rate, except when the transaction results in an
employee's being paid from a pay plan with steps, the employee shall be paid at
a step in the pay plan that is closest to but not less than the employee's
current pay rate.
PAY UPON RECLASSIFICATION [DAS-HRE Rule IAC—53.6(9)]
If an employee's
position is reclassified, the employee shall be paid as provided for in the
rules on promotion, demotion or transfer, whichever is applicable.
PAY UPON RETURN FROM LEAVE [DAS-HRE Rule IAC—53.6(10)]
If an employee
returns from an authorized leave, the employee shall be paid at the same step
or pay rate as prior to the leave, including any pay increases to which the
employee would have been eligible if not on leave.
PAY UPON RECALL [DAS-HRE Rule IAC—53.6(11)]
If an employee is
recalled in accordance with DAS-HRE Rule 11.3(6), the employee shall be paid at
the same step or pay rate as when laid off or bumped, including any pay
increases to which the employee would have been eligible if not on leave.
PAY UPON REINSTATEMENT [DAS-HRE IAC—53.6(12)]
When an employee is
reinstated in accordance with DAS-HRE Rule 57.5, the employee may be paid at
any step or pay rate for the class to which reinstated. When the rate of pay is above the minimum,
the decision to do so must be in accordance with DAS-HRE Rule 53.5(1) (advanced
appointment rates).
WITHIN GRADE INCREASES [DAS-HRE Rule 53.7]
All employees in permanent positions are eligible for a within grade increase, unless they are being paid at the maximum pay rate for their class. Within grade increases cannot be granted retroactively, unless they are the result of an error or omission. Corrections for errors or omissions can only be made for up to 90 days (six pay periods) following the employee’s eligibility date. Beyond that, a claim must be submitted to the State Appeal Board for payment. Seasonal and temporary employees are not eligible for within grade increases.
For employees not
covered by a collective bargaining agreement, within grade increases:

are not automatic.
·
minimum service required for
eligibility is one year, except for the probationary period and employees who
receive an increase in base pay as a result of promotion, reclassification or
pay grade change.
·
may be given anytime on or after the
employee’s pay increase eligibility date.
·
must be accompanied by a current performance
rating, which includes all or a part of the 12 months prior to the increase
date.
·
requires that employees have a
performance rating of at least "meets job expectations."
·
may be given in any amount up to the
maximum pay rate for the employee’s class.
For
employees covered by a collective bargaining agreement, within grade increases:
·
are automatic.
·
the minimum service required is one
year except for the probationary period.
·
must be given on the employee’s
eligibility date.
·
are given in step or percentage
increments depending on the pay plan from which the employee is paid.
Within grade increases may vary between collective bargaining
agreements. For contract-covered
employees, check the applicable bargaining agreement for terms/conditions.
Accurate records of pay increase eligibility dates should be kept on all employees. Within grade pay increases for employees covered by collective bargaining agreements are done automatically in the payroll system. For employees not covered by collective bargaining agreements, provide the agency’s personnel assistant with a copy of the employee’s performance evaluation. The personnel assistant will process the documents necessary to grant the pay increase.
